Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of superpudding.art's website at superpudding.art, online art courses, video lessons, purchases, and optional questions and feedback services (collectively, the "Service"). By creating an account, purchasing access, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and authorize your purchase. You represent that the information you provide is accurate and that you are legally able to enter into this agreement.
3. Accounts
Course access is associated with your individual account. You are responsible for protecting your login credentials and for activity conducted through your account. You may not sell, transfer, share, or make your account available to another person. Notify us promptly if you suspect unauthorized use.
4. Purchases and payment
Prices and included access are shown before checkout. Payments are processed by Stripe and may be subject to Stripe's terms. You authorize us and Stripe to charge the payment method you provide for the displayed total, including any applicable taxes. You are responsible for providing accurate billing information.
A purchase grants access only to the courses and services identified at checkout. Owning one course does not grant access to another course unless your selected option expressly includes both. Purchases are personal and may not be resold or transferred.
5. Refunds
Because digital course access is delivered promptly after a successful payment, purchases are generally final and non-refundable once access has been provided. We may consider refund requests in our discretion. Nothing in these Terms limits any refund, cancellation, or withdrawal right that cannot legally be waived where you live. 6. Course access
Subject to these Terms, purchasing a course gives you a limited, personal, non-exclusive, non-transferable right to stream the included lessons for your own educational use. "Lifetime access" means access for as long as superpudding.art continues to operate and offer the applicable course. It does not guarantee that every lesson, feature, hosting provider, or delivery method will remain unchanged forever.
We may update, replace, reorganize, or remove course materials when reasonably necessary, including to correct errors, improve instruction, address legal concerns, or replace discontinued technology. We will make reasonable efforts not to materially reduce the core educational content of a purchased course without providing an appropriate alternative.
7. Questions and feedback access
If your purchase includes Mentorship with superpudding.z for questions or feedback, that access is personal to you and intended for reasonable, course-related questions and artistic feedback. Unless expressly agreed otherwise, it does not include unlimited messages, guaranteed response times, live meetings, commissioned artwork, or emergency support. Responses reflect artistic opinion and instruction and do not guarantee a particular result.
Communications must remain respectful and lawful. We may set reasonable limits or suspend contact access if it is used abusively, excessively, for harassment, or for a purpose unrelated to the Service.
8. Intellectual property
The Service and its course videos, demonstrations, text, images, graphics, branding, downloads, and other materials are owned by superpudding.art or its licensors and are protected by intellectual-property laws. Except for the personal streaming right expressly granted above, no rights are transferred to you.
You may not, without our prior written permission:
- Copy, download, record, reproduce, republish, or redistribute course materials.
- Share lesson links, access tokens, credentials, or course files with others.
- Resell, sublicense, publicly display, or commercially exploit the Service.
- Circumvent access controls, video protections, or other security measures.
- Use course materials to create a competing course or content library.
9. Your artwork and submissions
You retain ownership of artwork, messages, and other content you submit. When you send material for feedback or support, you grant us a limited, non-exclusive license to host, copy, view, and use that material only as reasonably necessary to provide the requested feedback, operate the Service, resolve disputes, and comply with law.
You represent that you have the right to submit the material and that it does not violate another person's intellectual-property, privacy, publicity, or other rights. We will not use your submitted artwork in public marketing without separate permission.
10. Acceptable use
You may not use the Service to:
- Break the law, infringe another person's rights, or facilitate fraud.
- Harass, threaten, impersonate, or harm another person.
- Upload malicious code or interfere with the Service or another user's access.
- Scrape, probe, reverse engineer, or access the Service through unauthorized means.
- Automate access in a way that creates unreasonable load or bypasses restrictions.
11. Third-party services
The Service relies on third parties such as Supabase, Google, Stripe, Cloudflare, and Render. Their services may be governed by their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
12. Availability and termination
We aim to keep the Service available but cannot guarantee uninterrupted or error-free operation. Maintenance, security events, provider outages, or circumstances outside our control may temporarily affect access.
We may suspend or terminate access if you materially violate these Terms, engage in fraud, share purchased content or credentials, threaten the Service or others, or fail to pay amounts owed. Where reasonable, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination will remain in effect.
13. Educational disclaimer
The Service provides art education and subjective artistic feedback. Individual results depend on practice, materials, experience, and other factors. We do not guarantee any particular artistic, professional, commercial, or financial outcome.
14. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, superpudding.art and its owners, instructors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Service.
To the fullest extent permitted by law, our total liability for claims relating to the Service will not exceed the amount you paid to superpudding.art during the twelve months before the event giving rise to the claim. These limitations do not apply where liability cannot legally be limited.
16. Changes to these terms
We may update these Terms to reflect changes to the Service, our practices, or applicable law. We will post updated Terms here and revise the effective date. Material changes will apply prospectively, and we may provide additional notice where appropriate. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
17. General terms
These Terms and the Privacy Policy form the entire agreement between you and superpudding.art concerning the Service. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer or reorganization.
